美国u签证成功高吗?
U Nonimmigrant Visa for Victims of Crimes 受害者刑事犯罪难民签证,又被称为CRV/Crime Victim Visa, Crime Victim Asylee or U visa. CRV是一种非移民签证(Non-Immigrant Visas),它让受害的外国人能够停留在美国,同时为将来获得永久居留权或公民身份做准备。该签证申请人为那些因“受到外国政府的严重犯罪”而遭受痛苦的人,并且申请人必须证明他们已正式向美国政府报告了他们的犯罪经历并正在协助调查该案件的政府机构。
2017年5月3日, 特朗普签署了《加强保护美国境外人口不受剥削和犯罪的法令》(Strengthening Protections Against Sexual Assault and Other Crimes in the Refugee Act) ,该法允许美国移民局在评估某些人的申请时考虑任何与犯罪行为有关的指控,包括被撤销的指控、未被定罪或有罪裁定,这给CRV的申请增加了更多的不确定性。
虽然U签证没有明确的通过率的数据统计,但是根据经验来讲,因为申请人往往已经被美国警方立案,案件已经进入调查阶段甚至已经审判完毕,所以只要申请人在递交签证材料的时候配合移民局完成调查工作,基本上都会通过签证申请。 但如果申请人被撤销的案件涉及强奸等重罪,由于移民局可以查阅原案件的卷宗和判决记录,这些案件往往会在审核中遇到阻碍。
另外需要注意的是,即使申请人已经在美国居住超过五年并获得永久居民的身份,仍然可以通过CRV回到美国生活而不必离开美国。 一旦CRV持有人获得了永久居民或者公民身份,他们可以选择放弃CRV的权利以保持其永久居民的资格。但如果他们选择保留CRV,他们仍然有资格在今后再次成为美国公民。
U nonimmigrant visas are only available to victims who have been “substantially" harmed by a crime committed against them, their spouse , children under 21 years old (if they're unmarried), parents if those relatives were not born in the United States OR if they were citizens at the time of entry into the US but no longer are due to naturalization. They should be “unable to secure timely and effective assistance from the country where the crime was committed”, and must provide evidence that they’ve reported the crime, assisted law enforcement, and would suffer "extreme hardship" if forced to leave the US. Applicants must also have been granted temporary protected status through the Department of Homeland Security before October 1, 2001, because it takes about four months after filing an application with DHS to get TPS. In some cases CRV is issued retroactively to apply back to when applicants filed their initial DHS applications.
